Payment:

All pre-made sales are final, and no refunds or exchanges will be issued. 

For custom covers a 50% non-refundable deposit is required when work begins on a date outlined when the commission is booked. The remaining balance is due upon approval of the cover design. Complete payment is necessary before any files are sent. 

The final payment must be settled within 7 days of receiving the final invoice.

Late Payments:

 A late fee of 10% per week will be charged each week payment is not received after the due date. 

If a payment remains unpaid for more than 90 days after its due date, Sage and Fable reserves the right to terminate any future contracts or bookings, excluding premade covers without refund. Premade covers in this circumstance will no longer be eligible for any add-on service. 

Design Changes:

3 revisions TOTAL will be allowed to the cover after initial approval of the design. Additional revisions will be $20 each (This includes, but isn't limited to, font, color changes, graphics, major vibe changes, etc. it does not include minor things like visibility)

If the main cover image changes after work has begun, there will be an additional $50 charge, per image change.

The client acknowledges that only Lindsay of Sage & Fable is authorized to make alterations to any designs, whether in whole or in part. Any modifications after approval or receipt of final files may incur additional charges. Alterations made by the client may result in the termination of the future working relationship.

Timeline:

Sage & Fable is not liable for missed client deadlines caused by changes or tight scheduling on the client's part. Any rush deadlines need to be communicated in advance and may incur a $50 fee for custom covers.

Rights:

Sage & Fable offers photo-manipulated cover design or artwork services, the assets are acquired from third-party vendors, including stock images, 3D models, or fonts. Each asset is protected by the license of a third-party vendor. Sage & Fable exclusively employs licensed and royalty-free images, 3D models, and fonts in their projects.

The images used for the client's cover are royalty-free, but the photographer retains the copyright to those photographs.

For book covers and merchandise designs, Sage & Fable provides the client with an exclusive license for the final design. 

If the client provides Sage & Fable with assets subject to third-party intellectual property rights, they must ensure they have the necessary rights before requesting we incorporate them. In the event of any intellectual property dispute related to the provided assets, the client assumes full legal and financial responsibility.

When providing assets for the project, the client bears sole responsibility for ensuring the validity of copyrights, trademarks, and ownership.

The client agrees to protect, absolve, and defend Sage & Fable from any legal actions related to copyright and permission infringement arising from the assets provided by the client.

Cancelation:

Premade covers can not be returned.

If cancellation of a custom cover occurs before work commences, no expenses are owed. 

If work has started, the remaining balance becomes payable at the time of cancellation. Once the work is booked, no refunds will be provided.

If a client goes 30 days without communicating or responding to attempts to contact the contract is considered canceled and the remaining balance becomes payable. After this time the standard late payment schedule will be followed.

Credit and Ownership:

Sage & Fable retain complete rights to all original artwork and concepts encompassing layout, image style, placement, and fonts unless otherwise agreed upon. No one, including the client or another artist, is allowed to recreate the artwork or concept.

Sage & Fable always retain limited rights to the cover for self-promotion, portfolio purposes, client viewing ,and more.

Sage & Fable mandates design credit in the form of "Cover Design by Sage & Fable" to be included in all formats where the work is used. 

Liability:

Sage & Fable disclaims liability for any damages, including loss of revenues, profits, business, reputation, or data, associated with their services. They are not responsible for claims, losses, or injuries arising from errors or inaccuracies on our site or in our clients’ written documents once the cover has been approved.

If Sage & Fable faces delays in completing the project beyond the initially indicated time frame, such as due to a family emergency or an act of nature, the client will be notified via email. Both parties will then agree upon a new project completion date.

Sage & Fable affirms that, to the best of their knowledge, the work produced is an original creation that has not been previously published, or consent to use has been acquired on an unlimited basis. The work does not include scandalous, libellous, or unlawful content. The client and others are prohibited from using Sage & Fable' product in any manner that may infringe upon the rights of others.

AGREEMENT:

Both Sage & Fable and the client will acknowledge acceptance of the terms outlined in the contract. By acknowledging this contract, the client agrees to absolve Sage & Fable entirely from any liability, including financial obligations. Payment of premade or custom cover invoice constitutes agreement to these terms.
